New Publication on Smart Contracts and Procedural Law in Cross-Border Disputes

The Procedural Law Unit (PLU) of the University of Nicosia is pleased to announce the publication of a new article by its Director, Dr Nicolas Kyriakides, and Research Associate Ioanna Dimitra Theodosopoulou, entitled “Smart Contracts vis-à-vis Procedural Law: Jurisdictional Challenges, Recognition and Enforceability in Cross-border Disputes”, published in the European Journal of Law and Technology.

The article examines the legal and procedural challenges arising from blockchain-based smart contracts, with particular emphasis on jurisdiction, legal recognition and enforceability in cross-border disputes.

It explores how the decentralised and self-executing nature of smart contracts challenges traditional procedural frameworks and considers potential legal and institutional responses, including procedural reforms, judicial expertise and the treatment of blockchain-based evidence.

The publication contributes to ongoing discussions on the digitalisation of justice and the need to ensure legal certainty, procedural fairness and effective judicial protection in an increasingly digital legal environment.
